The Florida Bar has decided to investigate probate and real estate laws with regard to same-sex couples. The bar created an eight member committee to in June to study the issue and how it will effect legally married same-sex couples who move to Florida.
Chairperson of the committee, West Palm Beach attorney Michael Gelfand said, ”Part of what we do is anticipate issues and make recommendations. This affects not only same-sex couples, but if you are acquiring property from a same-sex couple, you want to make sure the documentation is properly executed.”
A recent ruling declaring Florida’s ban on same-sex marriage unconstitutional may already be having effect. A Monroe County circuit judge issued the first decision striking down Florida’s same-sex marriage ban in July. It is imperative that these issues be addressed quickly to assure the civil rights of all citizens.
The committee is expected to issue a report in November.
